Andy Sanchez-Azaba/Mexico/Driving Under the Influence

Andy Sanchez-Azaba, a Mexico national found to be in the country illegally, was arrested in Caldwell, Idaho, on charges of driving under the influence and unlawful reentry.

DUI arrests involving illegal aliens typically result in two separate legal processes being initiated simultaneously. State prosecutors handle the traffic offense through the state court system, where a DUI conviction can carry fines, license suspension, and possible incarceration. At the same time, federal immigration authorities file holds that prevent release pending an immigration hearing, initiating a removal proceeding in immigration court. Both processes are now underway for Sanchez-Azaba and will move on independent timelines.

Sanchez-Azaba remains in ICE custody pending a hearing before a federal immigration judge. No trial date on the criminal charges has been announced publicly. If the immigration court orders removal, Sanchez-Azaba would be returned to Mexico.
