Benito Guerrero-Carranza, a 51-year-old citizen of Mexico and an illegal alien present in the United States, was recently arrested by ICE officers following his apprehension by local law enforcement. Guerrero was taken into custody after being arrested for unauthorized use of a vehicle, a criminal offense that led to his referral to ICE for immigration enforcement action.

A review of Guerrero’s records confirmed that he is unlawfully present in the U.S. with no legal status or pending lawful immigration relief. ICE officers assumed custody of Guerrero after his criminal arrest and transported him to an immigration detention facility where he will remain throughout the course of his removal proceedings.

Guerrero’s current charge adds to a pattern of criminal behavior that warrants detention and deportation proceedings under federal immigration law. ICE placed a detainer on him following his arrest to ensure custody transfer once his local charges were addressed. Now under federal custody, his immigration case will be reviewed by an immigration judge.

Because of his illegal presence and the nature of his recent criminal offense, Guerrero will not be eligible for release and will remain detained pending further court action. If the immigration judge upholds his removal order, ICE will coordinate his return to Mexico once proceedings are complete.
