Marco Alfonso DeSantiago-Guajardo/Mexico/Aggravated Sexual Assault
In May 2025, U.S. Immigration and Customs Enforcement (ICE) announced the removal of Marco Alfonso DeSantiago-Guajardo, a 22-year-old Mexican national, following his arrest and detention by Enforcement and Removal Operations (ERO) El Paso. DeSantiago-Guajardo was previously convicted in Texas of aggravated sexual assault of a child, a first-degree felony under state law. The victim in the case was under the age of 14.
According to court documents, DeSantiago-Guajardo was arrested in 2022 and charged after a child victim disclosed the assault during a forensic interview. Investigators corroborated the statements and arrested him shortly thereafter. He later pleaded guilty to the charge and was sentenced to 10 years of probation, a term that included mandatory sex offender registration, regular reporting, and restrictions on contact with minors.
Due to his undocumented status and the severity of his conviction, ICE issued a detainer and initiated removal proceedings. A final order of removal was issued against DeSantiago-Guajardo in 2024 by an immigration judge in Texas. He remained in ICE custody throughout the removal process.
In May 2025, ERO officers carried out the physical removal of DeSantiago-Guajardo to Mexico. ICE officials confirmed that he is now permanently barred from returning to the United States due to his conviction and immigration violations.
