A transgender illegal immigrant released into the U.S. under the Biden administration only got a six-month sentence this week after pleading guilty to raping a 14-year-old boy in New York City.
Nicol Alexandra Contreras-Suarez, 31, pleaded guilty to second-degree rape in a Manhattan court on Tuesday, the New York Post reported. The six month-sentence was already served as part of a deal reached with the Manhattan District Attorney that prevented the victim from having to testify during the trial.

In February 2025, Contreras-Suarez followed the boy into a bodega bathroom in East Harlem, then attacked him. The victim sought help from bystanders after the attack, and Contreras-Suarez was arrested the next day.
“We expect the defendant to remain detained and be deported following sentencing, due to the felony conviction,” a spokesperson for the DA’s Office told the Post after a judge accepted the plea.
Contreras-Suarez, who’s from Colombia, will be sentenced on April 27 and could walk free if not taken into custody by ICE, which has a detainer request, the Post reported.
According to the U.S. Department of Homeland Security, Customs and Border Protection arrested Contreras-Suarez for entering the U.S. illegally in March 2023 during the Biden administration, but released him.
Contreras-Suarez was also released by local law enforcement in Massachusetts after being arrested on armed robbery and prostitution charges due to sanctuary policies, DHS said at the time.
“This creep should’ve never been released into our country,” DHS Assistant Secretary Tricia McLaughlin said last year. “Thanks to the failed sanctuary policies and Biden’s open-border agenda, this serial criminal was freed to prey on innocent American children – but that ends now. ICE will not allow predators like Contreras-Suarez to terrorize American citizens.”
Contreras-Suarez’s light sentence baffled some Manhattan legal experts.
“I didn’t know you could get six months on this,” Seth Zuckerman, a criminal defense attorney and former prosecutor told the Post. “It’s generally a minimum of two and a maximum of seven, so I think something must be wrong here.”
Mark Bederow, a defense attorney and former prosecutor, called t he sentence “extraordinarily low” in comments to the Post.
“Traditionally, somebody who is preying upon a child, following them into a location and raping them — that’s a terrible crime,” he said.
