ICE officers in Charlottesville arrested David Ambrosio‑Herrera, a 36‑year‑old illegal alien from Mexico, on September 25 immediately after he left a Virginia courthouse. Ambrosio‑Herrera had just been convicted in Albemarle County Circuit Court of indecent liberties with a child under 15 for exposing himself to a child at a school bus stop, receiving a six‑year prison sentence that the court fully suspended while ordering him onto the sex‑offender registry and supervised probation.​

Records show Ambrosio‑Herrera has illegally entered the United States at least three times since 2007, including two encounters that ended in voluntary returns to Mexico and a later unlawful reentry at an unknown time and place. His criminal history in Virginia includes a 2014 conviction for identity theft involving a fictitious ID card and 2017 charges for five counts of perjury for falsely subscribing written declarations, which prompted ICE Harrisonburg to initiate earlier removal proceedings.​

An immigration judge ordered him removed to Mexico on May 15, 2024, but he remained in the country until ICE Washington, D.C.’s Harrisonburg suboffice apprehended him after a brief foot chase outside the courthouse. He now remains in ICE custody pending execution of his removal order.​
