Gumercindo Remigio-Ortega/Mexico/Sexual Abuse in the First Degree
Gumercindo Remigio-Ortega, a Mexican national, was arrested by U.S. Immigration and Customs Enforcement (ICE) following convictions for attempted unlawful sexual penetration in the first degree and sexual abuse in the first degree. The charges establish a pattern of serious sexual offenses involving forcible, nonconsensual conduct.
Remigio-Ortega’s convictions document conduct involving forcible, nonconsensual sexual contact that met first-degree elements under state law. Court records indicate the penetration count was adjudicated as an attempt, while a separate first-degree sexual abuse conviction was also obtained. The two felony convictions reflect separate acts within the same criminal episode or connected sequence, documenting both an effort to commit penetration and completed abusive contact.
Following the completion of his criminal sentence, ICE Enforcement and Removal Operations (ERO) took Remigio-Ortega into custody. He is currently detained pending removal proceedings to Mexico.
“ICE prioritizes the removal of foreign nationals convicted of serious sexual offenses, particularly those involving first-degree charges,” said an ICE spokesperson. “These convictions represent some of the most serious sexual assault offenses under state law, and our enforcement actions reflect our commitment to protecting potential victims.”
The arrest represents ICE’s continued focus on foreign nationals with first-degree sexual offense convictions. The case was coordinated between federal immigration authorities and state law enforcement agencies that initially prosecuted the criminal charges.
