ICE San Francisco arrested Jair Jose Nunez, 37, a citizen of Mexico who is unlawfully present in the United States. According to court and law enforcement records, Nunez has two prior convictions for driving under the influence and is currently facing a third DUI case. He was taken into custody in the Bay Area and transferred to an ICE facility, where he remains while removal proceedings advance before an immigration judge.

A DUI conviction is entered when prosecutors prove a person operated a motor vehicle while impaired by alcohol or drugs. Evidence commonly includes standardized field sobriety tests, chemical analyses, officer observations, and dash or body camera recordings documenting the stop and arrest. Multiple convictions indicate recurring impaired driving despite prior sanctions such as fines, license restrictions, treatment requirements, ignition interlock orders, or jail time, and that pattern is weighed by courts and immigration authorities during risk and custody assessments.

The pending third DUI is an allegation, not a conviction. That state case will be adjudicated in the appropriate court under the required burden of proof, and its outcome will be reflected in the immigration file when resolved.

During intake, immigration officers verified identity through biometrics, compiled certified copies of the DUI judgments, and reviewed Nunez’s immigration history for presentation in court. He will remain detained while hearings are scheduled and while any required travel documentation would be coordinated with the receiving government if a final order of removal is issued. Criminal and immigration matters proceed on separate tracks, with the state court addressing the new charge and the immigration judge determining removability and custody under federal law.
