Lucio Ortega Flores/Mexico/Driving Under the Influence

Lucio Ortega Flores, a Mexico national living in the country illegally, was taken into custody by ICE agents in Nampa, Idaho, on charges of driving under the influence and unlawful reentry.

DUI arrests involving illegal aliens typically result in two separate legal processes being initiated simultaneously. State prosecutors handle the traffic offense through the state court system, where a DUI conviction can carry fines, license suspension, and possible incarceration. At the same time, federal immigration authorities file holds that prevent release pending an immigration hearing, initiating a removal proceeding in immigration court. Both processes are now underway for Flores and will move on independent timelines.

Flores is currently in federal immigration custody awaiting a hearing before a Department of Justice immigration judge, which will determine whether removal to Mexico is ordered.
