Luis Alvarado Ochoa, a Mexico national living in the country illegally, was taken into custody by ICE agents in Clovis, New Mexico, on charges of dangerous drugs.

Drug possession charges involving illegal aliens frequently result in dual proceedings — a criminal case handled at the state level and a concurrent immigration enforcement action initiated by federal agents. Even misdemeanor drug possession can serve as a trigger for immigration detention, particularly when the individual has no lawful status and no prior legal ties to the country. Ochoa now faces both a state criminal case and a federal immigration proceeding, each capable of producing consequences independent of the other.

Ochoa is currently in federal immigration custody awaiting a hearing before a Department of Justice immigration judge, which will determine whether removal to Mexico is ordered.
