ICE San Diego arrested Raul Diaz, 62, a citizen of Colombia who is unlawfully present in the United States. According to court and law enforcement records, Diaz’s criminal history includes a conviction for embezzlement of public property. He was taken into custody in the San Diego area and processed for immigration detention while his administrative case proceeds before an immigration judge.

Embezzlement of public property is charged when an individual entrusted with government funds or assets intentionally diverts them for unauthorized use. Prosecutors typically substantiate this offense with audited ledgers, bank and procurement records, access logs, chain-of-custody documents, and witness testimony establishing position of trust and personal benefit. Forensic accounting analyses and recovery records often corroborate the amount and disposition of the misappropriated assets. A conviction reflects judicial findings that the elements—entrustment, conversion, and intent—were proved beyond a reasonable doubt.

Following his apprehension, officers completed biometric identity verification, compiled certified judgment and sentencing documents, and reviewed immigration history for presentation in court. Diaz remains detained while removal proceedings advance, including custody review and hearings before an immigration judge. The criminal and immigration matters proceed on separate tracks: the completed or ongoing state proceedings determine criminal liability and sentence, while the immigration court evaluates removability under federal statute based on the record of conviction and current status.

If a final order of removal is issued, officials will coordinate travel documentation with the receiving government and schedule transportation in accordance with federal procedures. Upon transfer to that authority, the United States custody portion of the immigration matter concludes, and the certified criminal judgment remains part of the permanent file used in any future admissibility determinations.
