Ubaldo Luna-Rojas, a 44-year-old citizen of Cuba who is illegally present in the United States, was arrested by ICE San Antonio officers. Luna-Rojas has a criminal conviction for driving while intoxicated (DWI), stemming from a 2011 incident in Texas. According to court documents, Luna was operating a motor vehicle under the influence of alcohol, placing other drivers and pedestrians at risk. He was arrested, charged, and subsequently convicted of DWI, a misdemeanor offense that remains on his criminal record.
Following years of unlawful presence in the U.S., an immigration judge issued a final order of removal for Luna-Rojas in 2021. The order required him to leave the country, but Luna failed to depart voluntarily or comply with the court’s directive. He continued to reside unlawfully in the U.S., prompting further enforcement action.
ICE located and arrested Luna-Rojas during a targeted enforcement operation focused on individuals with prior removal orders and criminal histories. Because of his previous conviction and defiance of a court-issued order of removal, he was taken into ICE custody without incident.
Luna-Rojas will remain in detention while his case is reviewed for removal proceedings. ICE officials confirmed that his prior DWI conviction and failure to comply with the immigration court’s order were key factors in his apprehension and continued detention. He is being held at a federal facility pending final resolution of his immigration status.
