A transgender criminal illegal alien from Colombia busted in New York City for allegedly raping a 14-year-old boy in a bathroom was bound over for trial this week.
Nicol Alexandra Contreras-Suarez, a biological male that identifies as a woman, faces charges for first-degree rape of a child less than 17 and stalking in a case that shocked many New Yorkers.
Contreras-Suarez had a preliminary criminal hearing in New York City and is set to appear before the New York Supreme Court on Sept. 10, according to the U.S. Department of Homeland Security.
Details of the case are disturbing—and another example of failed sanctuary policies across the country. The heinous crime occurred in February, after Contreras-Suarez was released for a series of crimes in Massachusetts.
Contreras-Suarez allegedly followed the teen boy into the bathroom of a bodega across the street from Thomas Jefferson Park in East Harlem and attacked him, police and sources told The New York Post.
The boy fled the bathroom and told witnesses, who alerted police and arrested Contreras-Suarez a day later. The Post posted surveillance footage showing Contreras-Suarez inside the East Harlem store.
Contreras-Suarez has been labeled among the “worst of the worst” by DHS. This serial criminal entered the U.S. illegally and was released into the country under the Biden Administration.
“This horrific and preventable crime illustrates the consequences of the Biden administration’s catch and release and sanctuary policies,” the agency said in a news release.
DHS Assistant Secretary Tricia McLaughlin added: “This creep should’ve never been released into our country.”
U.S. Customs and Border Protection arrested Contreras-Suarez in San Ysidro, California, in March of 2023 and let him go him into the country.
Contreras-Suarez made his way to the East Coast, where he went on to commit heinous crimes in American communities.
The trans migrant was arrested in June 2024 in Medford, Massachusetts, but was somehow let go, The Boston Herald reported.
The Medford Police Department arrested Contreras-Suarez for armed robbery, prostitution and assault with a dangerous weapon. However, “due to local sanctuary policies,” DHS said, Contreras-Suarez was once again released.
“Thanks to the failed sanctuary policies and Biden’s open-border agenda, this serial criminal was freed to prey on innocent American children – but that ends now,” McLaughlin said in a statement. “ICE will not allow predators like Contreras-Suarez to terrorize American citizens.”
Suarez was wanted in New Jersey and Massachusetts at the time of the New York assault, and U.S. Immigration and Customs Enforcement had a detainer on him, a law enforcement source told The Post in February.
“It just goes to show that Donald Trump and [border czar] Tom Homan are correct that you need to get the violent people out of New York City and Eric Adams, Letitia James and Kathy Hochul should all cooperate because this person has an ICE detainer,” the source said.
Prosecutors initially asked for $500,000 bail and $1.5 million bond for Suarez, the law enforcement source said. But Judge Elizabeth Shamahs, a Democrat, lowered the amount to $100,000 bail or $250,000 bond, online court records show.
ICE lodged an immigration detainer with Manhattan Central Booking on Feb. 13, 2025, DHS said. Contreras-Suarez will remain lodged at Rikers Island in New York until his next court hearing.
Meanwhile, ICE continued its roundup of child sexual predators and egregious criminal illegals this week, “including an illegal alien from Sierra Leone convicted of raping an 11-year-old Maryland girl 15 times in a 5 month span in 2014, and a Venezuelan illegal alien w/ six felony convictions in MD including armed robbery, handgun use during a felony, first degree assault, and drug distribution,” Fox News’ Bill Melugin shared on X.
