Agustin Garibay-Garibay, a Mexican national, was arrested by U.S. Immigration and Customs Enforcement (ICE) following convictions for attempted sodomy in the second degree, delivery of marijuana, driving under the influence of intoxicants, and harassment. The charges establish a pattern of criminal conduct spanning sexual offenses, drug distribution, impaired driving, and unlawful harassment.
Garibay-Garibay’s convictions include an attempted sexual assault charge that met second-degree elements under state law. Court records also document drug distribution activity involving marijuana, a DUI conviction reflecting impaired operation of a motor vehicle, and a harassment conviction establishing unlawful conduct directed at another individual. Additional records indicate a probation violation and a prior arrest for fourth-degree assault.
Following the completion of his criminal sentence, ICE Enforcement and Removal Operations (ERO) took Garibay-Garibay into custody. He is currently detained pending removal proceedings to Mexico.

The arrest represents ICE enforcement action against a foreign national with convictions spanning sexual assault, drug crimes, and impaired driving offenses. The case was coordinated between federal immigration authorities and state law enforcement agencies that initially prosecuted the criminal charges.
