Immigration agents have arrested another illegal immigrant accused of child sex crimes—this time in Virginia—after local officials released him from jail.
U.S. Immigration and Customs Enforcement arrested Walvin Victor Hugo Garcia, from Guatemala, on May 1 after his appearance in Fairfax County Court. Officials did not notify ICE and Hugo Garcia was allowed to leave court despite ICE issuing a detainer.
Garcia is another Biden-era catch-and-release Guatemalan migrant who made his way to sanctuary Fairfax County, Virginia. In February 2025, an immigration judge in Virginia issued Garcia a final order of removal, but he wasn’t deported before getting arrested for sex crimes against a child.

Garcia was arrested in June 2025 for felony charges of rape of a child less than 13 years of age, aggravated sexual battery of a victim under 13 years of age, use of a computer to commit sex offense with a minor, and distributing drugs to a minor.
The U.S. Department of Homeland Security continues to call out Fairfax County’s soft-on-crime policies, labeling it a “sanctuary calamity,” as the feds are probing Fairfax County for giving preferential plea deals to illegals.
ICE lodged an immigration detainer for Garcia following his initial arrest in June, but Garcia was allowed to leave court without ICE being notified, DHS shared in a news release.
“Governor Spanberger and her fellow sanctuary politicians in Fairfax, Virginia, refused to cooperate with ICE and RELEASED this child rapist from jail back onto the streets,” said Acting Assistant Secretary Lauren Bis. “Thanks to our brave law enforcement, this sicko is out of our communities.”
Newly elected Democratic Gov. Abigail Spanberger and Fairfax sanctuary politicians are “playing Russian roulette with American lives by releasing criminals from jail into American neighborhoods,” DHS said.
According to DHS records, Garcia entered the country illegally near Eagle Pass, Texas, in October 2023. He was then released by the Biden administration into the country.
Fox News Digital reported that, according to DHS, Garcia was released by Fairfax County and appeared for his court date on his own. DHS said that he was then arrested inside the courthouse but outside the courtroom without assistance from locals.
In a statement to Fox News Digital, a Spanberger spokesperson said the governor “strongly believes violent criminals who are in the United States illegally should be prosecuted to the fullest extent of the law and deported.”
Spanberger has repeatedly said Virginia is not a sanctuary state. The governor’s office added: “As a former federal law enforcement officer who went after child predators, Governor Spanberger will always prioritize the safety and well-being of Virginia’s families and kids.”
A Fairfax County Commonwealth’s Attorney spokesperson also told Fox News Digital that “we were actively prosecuting this individual for aggravated sexual battery and rape of a child.”
However, Spanberger’s policy initiatives since taking office indicate the governor, who campaigned as a moderate, has joined the leftist crusade to harbor illegal immigrants and promote soft-on-crime policies, ultimately putting Virginia residents in danger.
Spanberger rescinded local-federal 287(g) ICE agreements during her first days in office, reversing a policy put in place by former Republican governor Glenn Youngkin.
“Elections have consequences,” Border Czar Tom Homan said in an interview with Fox News in April. “[Spanberger] ran on a law enforcement position that she was a career law enforcement person. [She] is a much different person now since she’s in that governor’s slot.”
Fairfax County, across the Potomac River from Washington, D.C., has become a hotbed of illegal alien crime and made national headlines for a fatal bus stop stabbing and machete murder.
In April, ICE arrested Roni Mendez-Escobar, another Guatemalan, after Fairfax County authorities released him, despite being charged with possession of child porn with intent to distribute.
In another case last month, authorities arrested and charged Misael Lopez Gomez, of Guatemala, with murder and felony child abuse after bludgeoning his own 3-month-old daughter to death.
In March, Fairfax police arrested Anibal Armando Chavarria Muy, also from Guatemala, for a fatal machete attack. Muy was charged with second degree murder after fatally stabbing a man inside his home.
In February, Abdul Jalloh, an illegal alien from Sierra Leone with more than 30 prior arrests, was charged with murder after fatally stabbing 41-year-old Stephanie Minter at a bus stop.
And it’s the second case in recent weeks of sanctuary policies allowing child sexual predators to roam free.
In Illinois, another Democratic stronghold that harbors illegal migrants, ICE agents arrested a dangerous felon and child sexual predator from Guatemala who was released by Illinois’ state officials despite calls to turn him over to federal authorities.
Erik Giovanni-Quiroa, 41, has convictions for aggravated sexual abuse of a child and aggravated battery with a firearm. He has been in the country illegally for nearly 25 years, and he spent years in prison on the taxpayer’ dime.
ICE agents in Chicago arrested Giovanni-Quiroa on April 22 during a traffic stop after the Illinois Department of Corrections denied an ICE detainer request and released him into the community.
In 2025, he was convicted of aggravated sexual abuse of a 5-year-old child, DHS said. A judge only gave him a three-year prison sentence despite his previous criminal conviction for aggravated battery with a firearm.
